従来の市民農園は、地方自治体の助成措置によって都市農家が農地を提供し、市民がきわめて小面積の区画を利用するものであり、農地法の適用下における暫定的なものであった。(「入園契約方式」という)。しかし一方では市民の要望の強さと,他方における農家例の労働力不足により市民農園の発展の条件が成熟してきた.そこで1989年に特定農地貸付法が制定されて農家に農地を市民農園に提供する公的な道を開き,1990年には市民農園整備促進法が制定されてその整備の軌道が敷かれた。しかし、従来の入園方式も認められている。上記の両法律とも,ドイツのクラインガルテン法と比較すると,土地利用計画上の位置づけが弱い。したがって市民農園計画においては、他の土地利用との調整を計画者が自主的に進める必要がある。また日本の市民農園は,ドイツのように都市施設に特化しては発展の余地が少い。ドイツの場合は、都市と農村が峻別されているのに対し、日本では両者が混在する境界をはっきりさせることが困難だからである。そこで日本については,都市型,都市近効型,農村型の三類型を考え、都市の緑地保全、都市農村の交流の実現、都市民とくに子供のうるおいある生活の保障という機能が適切に果せるようにする必要がある。全国の市町村はこの問題にきわめて熱心であるが,とくにこれから大都市における過密の問題を迎えようとしている所では具体的な計画を持ち始めているところが見られる.埼玉県,神奈川県,大阪府,福岡県,北海道などがその例である。その中で、帯広市,福岡市の計画は,本格的な施設整備を伴う点で将来のモデルとしての意味が大きい。いずれにしてもこの問題は,土地利用の現状と土地所有・土地利用に対するものの考え方に規定されており,その点に対する深い配慮なしには解決が困難である。今後もこれに対する法社会学的研究が要求される。
