この研究は、日本の協議離婚制度の法社会学的調査研究により、その改革のための資料を提供することを目的とした。日本の協議離婚制度は、離婚意思が当亊者によって自由にかつ確定的に形成され、それが離婚届に正しく表示されることを前提している。しかし、その前提は必ずしも現実のものではない。離婚意思は浮動性と包括性を有し、かつ離婚届は提出に使者の使用を許し、かつ書面審査に服するにすぎない。したがって、離婚届が自由な離婚意思の表示であるという保障はない。現実に提出され、受理された離婚届の中には、さまざまなケースが含まれることになる。このような協議離制度の問題点をカバーするために、1952年以降、法務省の通達によって離婚届不受理申出制度が発展させられた。この制度は次第に整備されているが、離婚の協議の出発点を確保する機能をもつにすぎず、また制度の不備の被害者がまず行動しなければならない点において制度としての公正さを欠いている。協議離婚を経験した女性161名のアンケート調査によれば、以下のことが判明した。協議離婚に要する時間は長い(1年以上が56パーセント、2年以上が42パーセント)。離婚を迷った理由は子供のことが64パーセント、財産分与の額が13パーセント、その他が53パーセントである。協議離婚制度を現状でよいとするものは19パーセントで、他は改革を必要とすると考えているが、子供の問題や財産分与の問題を同時に解決することを求めているものが多い。完全な廃止論は10パーセントである。協議離婚の実態については、今後もさらに追究が必要であるが、中間的な意見としては、離婚届の手続を少くとも現在よりも慎重なものとすること、協議離婚の手続の中に、離婚後の生活の配慮を要望したい。
