本研究は、刑事手続において重要証人の黙秘権を喪失させ、証言を強制する「訴追免除(刑事免責)」の制度について、これが現に用いられているアメリカおよびドイツの状況を、その社会的・歴史的背景、制度の現状、運用の実際と問題点につき明らかにし、その知見に基づき、日本の憲法、刑事手続法の解釈論または制度の立法論としてこれを導入することの可否、導入の実務上の意味、導入する場合の具体的問題点と波及的影響につき、包括的に検討しようとしたものである。「黙秘権」の理解につき根本的修正に至る可能性があるため、「萌芽的研究」として申請した。なお、平成4年度にも同一課題で研究費の交付を受けている。本年度の実績は、以下のとおりである。1.平成4年度にアメリカ法の状況につき基礎資料を収集したので、本年度はこの知見を分析・評価する作業を行った。この結果、現状を客観的に紹介する論文を執筆できる準備をほぼ完了したが、後述の理由で、個別的紹介論文の形式での成果公表はしばらく見合わせることとした。2.ドイツ法の状況につき、資料収集と分析を行った。基礎資料は整ったが、運用の実際や問題点については、アメリカ法の研究に比して、いまだ充分ではない状況である。3.日本について、いわゆる「ロッキード事件」に関し、本研究課題に直接関係する最高裁判所の判例が近い将来予測される状況となった。このため、これまでの比較法的研究の整理・分析を継続しつつ、最高裁判例の動向を踏まえて論文を執筆することを計画し、その枠組を構想中である。1.2.で述べた知見は、この論文に組入れる形で公表を考えている。
