项目摘要

現在わが国では、従来比較的自由に行政の裁量に任されてきた行政指導の手続きに対し、透明性や公正性を確保するための行政手続法制定の動きがある。だかこの問題については、1952〜3年の国家行政運営法案の試みや、64年の第一臨調答申等古くから検討されてきた。また同様の趣旨で、行政情報公開法の制定やオンブズマン制度の導入、独占禁止法の強化等が検討されてきたが、一部を除いて未だに実現を見ていない(行政手続法は最近制定された)。他の先進諸国では、多少の違いはあるにせよ、これらの制度を既に導入している国が多い。なぜ他の国で導入されている行政手続法等の制定が、わが国ではされていないのか。本研究では、その理由を政策過程上の差異に求める。一般に、制度改革には政策決定システムの集権化が必要であるが、わが国のシステムは分権的といわれている。行政手続法等の場合にもそういえるのか。制度改革を実現させるのに必要な政策決定システムのあり方を明らかにする。平成5年度は、前年度に研究した小売り流通業と石油産業の規制緩和における行政指導の透明化・公正化の政策過程についての論文(「行政指導の規制緩和」)をレフェリー雑誌『レヴァイアサン』に発表することができた。また、最近成立した行政手続法の要綱および法案における行政指導のあり方について検討を加え、「行政指導と行政手続法」としてまとめた。この論稿は、他の論稿とともに『行政指導をめぐる政策過程』としてまとめられ、現在、慶應義塾大学において、博士学位請求論文として審査されている。今後は、これを公刊するとともに、制度改革をめぐる政策過程システムについての検討をさらに進めたい。
