日本行政手続法は一九九三年十一月五日に成立し、十一月十二日に公布され、翌(一九九四)年一〇月一日より施行されている。これに対して、台湾では、一九七七年より、行政手続の立法化作業が進んでいる。現在に至っては、四次の草案が出されており、最終の草案はすでに立法院に送付され審議をうけているところである。このように、本研究は、行政手続法の運用課題の検討や立法化の課題に直面している日本と台湾の行政手続論議の中で、公正な聴聞手続を実現するための公正な聴聞主宰者のあり方を考えるために、日本行政手続法と台湾行政手続法草案の聴聞主宰者の規定を一瞥し、それぞれの意味内容を比較法的に分析し理論的問題点を明らかにし、運用課題ないし立法的課題を整序するものである。具体的な構成については、まず、日本行政手続法における聴聞手続の法的構造を概観し、聴聞主宰者の関する法的根拠を個別法、行政手続法及び政令に分けて説明する。次に、台湾行政手続法の四次の草案においてそれぞれ聴聞手続の構造や聴聞主宰者の規定を概観する。さらに、両国の聴聞手続について、聴聞の範囲や各行政手法の聴聞に関する価値序列という二点で検討し、両国の聴聞主宰者について、基本的視点としての聴聞主宰者の独立性、公正性、専門性という観点から検討する。最後に、比較法的検討の結論として以下のように整理する。すなわち、日本と台湾との法制や行政運営等の事情が異なるため、両国の行政手続法(草案)を同一の基盤の下で一概に優劣について評価をすることができないが、理論的にいえば、全体として公正性について、台湾行政手続法草案は日本行政手続法より詳細な規定があり、公正性の確保の観点から明文化した台湾草案がよいといえようが、実際の運営状況においては、処分庁の指名にあたっては、処分庁の裁量判断が委ねられることで、明文規定がなくても、公正性を確保するための指名のあり方を運営することも可能であるため、明分規定の有無だけで両国の運用実態を評価しきれない側面があろう。独立性や専門性についても、建前の法制度を前提としつつ、公正・中立性の聴聞を確保するための解釈論が期待されよう。なお、聴聞に関する実定法、行政実務や裁判実務の欠如している台湾の現状においいて、聴聞主宰者についての解釈論及び立法論的課題よりは、むしろ聴聞の範囲の狭さを立法論的に解決するのが先行または併行の課題として考えるべきであろう。

The Administrative Manual Law of Japan was established on November 5, 1993, promulgated on November 12, 1993, and implemented on October 1, 1994. Finally, the conclusion of the comparative method is summarized as follows. Japan and Taiwan's legal system, administrative operation, etc. differ from each other. Taiwan's administrative manual law (draft) is based on the same foundation. It is good and bad. It is fair. Taiwan's administrative manual law draft has detailed provisions. The Taiwan draft law on ensuring fairness clearly states the state of operation, the designation of punishment, the discretion of punishment, the possibility of operation, the existence of clear provisions, and the state of operation of the country. Independence, openness, and the premise of establishing a legal system; impartiality, neutrality, and transparency; and expectations. The current situation in Taiwan is not as good as that of the implementation of laws, administrative affairs, and judicial affairs. The problem of legislative theory is not as good as that of the implementation of laws, administrative affairs, and judicial affairs.
