项目摘要

国際裁判における訴訟当事国の言動を通じて、国際裁判の実像を明らかにし、国際紛争の平和的解決のあり方を探ることを本研究は究極的目的とした。1年間でこの大きな目的の全てを達成することは困難であったが、以下のような研究を行い、一定の成果を挙げることができた。研究は、まず、具体的ケースとして、国際司法裁判所「対ニカラグア軍事・準軍事行動事件」および「シシリ-電子工業株式会社事件」における訴訟当事国の言動の精密な再検討を行うことから開始した。この過程において、裁判所による事実認定および証拠法理のあり方が訴訟当事国の訴訟戦略に極めて重大な影響を及ぼすこと、さらに、この事実認定および証拠法理は、国際裁判手続の中核をなす「共通課題」であるにもかかわらず、従来、内外ともに等閑視されてきた主題であることを再認識したため、この課題につき、国際司法裁判所、常設国際司法裁判所、国際仲裁裁判所の第1次文献(判決のみならず訴答書面も含む)およびこの主題に関する英仏伊語の第2次文献の収集・講続・分析を行なった。検討の結果は、「国際裁判における事実認定と証拠法理」という論文として脱稿できた(松田・尾崎編「流動する国際関係の法」国際書院、近刊、所収)。立証の対象、立証責任、推論と証拠法理、一方当事国不出廷の場合の事実認定と証拠、違法収集証拠の扱い等につき、明らかにすることができた。さらに、訴訟過程において生じた・また生じうる訴訟当事国の言動をめぐる諸課題について、訴訟過程の順に検討をすすめた。この点に関しては、今後さらに検討し、成果を発表したいと考えている。
