Career Mobility of the Judges

本研究旨在探讨影响法官升迁的因素。将法官的晋升定义为晋升为地区法院院长和/或高等法院审判长，采用布尔方法（定性比较分析）分析了从事劳动争议案件的法官的职业生涯数据。分析的重点是晋升到以前的职业生涯和判断的关系。结果总结为以下三点。第一，具备区域法院主审法官和高等法院法官的经验是晋升的必要条件。其次，以前借调到最高法院或司法部的职业生涯确保了晋升。最后，在劳动案件中只参与有利于行政机构或公共组织的判决，加快了晋升。研究结果表明，前职业经历和评价对晋升有影响。

The purpose of this research is to consider the factors those influence the promotion of judges. Defining the promotion of judges as moving up to a director of district court and/or a presiding judge of high court, career data of judges who engaged in cases of labor dispute are analyzed by Boolean approach (Qualitative Comparative Analysis). The analysis is focused on relations of the promotion to the former career and judgements.The results are summarized to the following three points. First, the experience of both a presiding judge of district court and a judge of high court is a necessary condition for the promotion. Second, the former career of secondment to the Supreme Court or the Ministry of Justice ensures the promotion. Last, participating only in judgements advantageous to administrative agencies or public organizations in labor cases, hastens the promotion. The results showed that the former career and judgements influence the promotion.
