项目摘要

プーフェンドルフの自然法論をヨーロッパ精神史のなかに位置づけるために資する可能性のある文献を収集・検討した。また、今年度も八日間チューリッヒ大学に滞在して、後期スコラ学派に関する文献調査を実施した。本研究は、自然法の学問としての自立化と、その枠内でのローマ法の訴権のシステムから独立私法のした一般理論の誕生の秘密を解明するという二つの柱からなる。ヨーロッパ私法の一般理論は、ローマ法の近代化のプロセスにおいて誕生するが、ローマ法の内在的な発展の力によっては、私法の一般理論を形成することは不可能であったという想定のもとで、私法の一般理論の誕生を促進した神学と哲学の影響を解明することに留意した。今年度は、神学の影響をみるために、後期スコラ学派のスアレスとレッシウスの研究を行った。ヨーロッパ大陸法系の制定法文化の成立のためには、私法の一般理論が必要不可欠であるが、これを構築するために、意思概念が重要な役割を果たす。意思概念が神学の影響によることは比較的よく知られているが、それがどのようなルートで法学に影響を及ぼすことになったのかということは、未解明の問題である。今年度の研究で、スアレス、デカルト、プーフェンドルフのラインをたどることができることが判明した。私法の一般理論の誕生のためには、もう一つ体系の配列の仕方についての考え方が問題であり、これについては、後期スコラ学派に属するレッシウスを中心に検討している。後期スコラ学派の道徳神学としての自然法論の内部で、restitutioを中心とした私法学が形成されており、ローマ法の現状回復を意味するrestitutio論を、損害賠償の意味でのrestitutio論に拡大し、これを中心とした私法の一般理論が模索されていたことが解ってきた。最終年度においては、restitutio論を中心とした一般理論の構築の試みから、グロチウス、プーフェンドルフの契約理論を中心とした一般理論への転換の理由を解明することが課題となる。
