项目摘要
Concerning this theme, subject of study and the result which do during this research period are as follows.1. It is the topic which is related to the coverage of labor law. The knowledge which is obtained with this topic making the needs of the various workers correspond without the former way limiting the scope of application of labor law to workers with employment relation was that it is necessary to reorganize labor law itself. "The memorandum regarding labor supply contracts similar employment and labor law" and "Diversification of employment forms and labor law" are the elementary results with regard to this study.2. It is the research regarding the legislative topic which accompanied the amendment of in 2003 and examined. "Meaning and problematical point of the amendment of Labor Standard Law concerning restrictions on Dismissals and regulations on fixed-term contract" is a fundamental result with these subjects of study. And, "Discretionary work system" and "Working Hour Schemes for White-Collar Employees in Japan" are results with the study for the amendment of Labor Standard Law concerning discretionary work system.3. It is the research regarding the topic of the labor laws which are related to the transfiguration of enterprise organization. The elementary research result in this topic is "Transfiguration of Labor Market and Enterprise Organization and labor law in Japan.
围绕这一主题,本研究所做的研究课题和研究成果如下.这是一个关系到劳动法覆盖范围的话题。从这一课题中获得的认识是,有必要对劳动法本身进行重组,使各种劳动者的需求相适应,而不是将劳动法的适用范围限制在有雇佣关系的劳动者身上。本研究之初步成果为“关于类似雇佣与劳动法之劳工供给契约之备忘录”与“雇佣形式与劳动法之多样化”。是伴随着2003年《刑法修正案》的修改而进行的关于立法课题的研究。“劳动基准法关于限制解雇和定期合同规定的修改的意义和问题点”是这些研究课题的基础性成果。另外,“自由工作制”和“日本白领劳动者的工作时间制度”也是为修改劳动基准法中有关自由工作制的内容而进行的研究成果。本研究是以企业组织变革相关的劳动法为研究主题。本课题的初步研究成果是《日本劳动力市场和企业组织的变化与劳动法》。
