医療の公共政策という文脈の中で正義論を再検討し、生命倫理学における正義論を批判的に再構築することが、本研究の目的であった。そのために、1)利益と危害の明確化、2)私益と公益の内容、および両者の対立構造、3)正義に求められるべき特質を中心に検討してきた。研究方法として、(1)文献研究、(2)事例収集、(3)論理研究を、3年度にわたって平行して行ってきた。本年度は、これらの集大成として単著『医療倫理学の方法-原則・手順・ナラティヴ』を刊行した。以下にその構成を示す。第1部 医療倫理の歴史(古代から近代の医療倫理の変遷、現代-患者の権利の時代へ)第2部 医療倫理学の方法、基本的な概念と構造、三つの方法論-原則・手順・ナラティヴ)第3部 死と喪失(死と喪失についてのレビュー、告知-深刻な診断を知る,それを伝えるということ、尊厳死-最後まで生きる,その人にかかわるということ)第4部 性と生殖(性=セクシュアリティについて、生殖について、障害児の出生を「防ぐ」ということ)第5部 患者の権利と公共の福祉(患者と第三者の利害の対立、自己危害と他者危害)第6部 医学研究と医療資源(生体と医療資源、医療資源の配分と医療情報)これによって、歴史的なレビューを行った上で、領域横断的な系統的な方法論を構築し、それに沿って各領域における事例と、これまでに提出されている議論を収集・整理し、個々の医療的文脈の中での指針を示すという結果を得ることができた。この成果を基礎として、正義論、物語論など、今後の生命倫理学の方法論の研究をさらに推進したい。

A re-examination of justice in the context of medical policy, a re-construction of justice in the context of bioethics, and the purpose of this study 1) Clarification of benefits and harms, 2) Content of private benefits and commonweal, 3) Discussion of justice and characteristics Research methods: (1) literature research,(2) case collection,(3) logical research, and (3) parallel research. This year's edition of "Methods of Medical Ethics-Principles, Procedures, and Guidelines" was published. The composition of the following is shown. Part 1 History of Medical Ethics (Ancient times, modern times, patient's benefits) Part 2 Methodology, Basic concepts, structure, methodology, principles, procedures, and loss of medical ethics Part 3 (Death and Loss, Information-Deep Diagnosis and Knowledge, Death and Honor-Death-Last Life and Death, Information-Deep Diagnosis and Knowledge) Part 4 Sexual Reproduction (Sex = sex, reproduction, birth, prevention) Part 5 Patient's benefits and public well-being Part 6 Medical Research and Medical Resources (Biological and medical resources, distribution of medical resources, and medical information). The methodology for constructing a cross-domain system along the lines of each domain is presented. The discussion is collected, organized, and presented in the context of each medical treatment. The foundation of this achievement, the theory of justice, the theory of matter, and the methodological research of bioethics in the future are all being promoted.
