本研究においては、近年わが国のみならず世界各国で問題となっている、人由来資料および情報を用いる研究の規制について検討した。今年度は特に、英国およびシンガポールにおいて、研究規制に関する法律案が国会に上程されたことから、この法律案の検討を行った。英国においては、小児心臓血管外科の術後に死亡した子どもの遺体を病理解剖後、その死体の部分を親の同意なく保存していた問題が大スキャンダルになり、これを受け、政府が、法律案を作成したものである。彼の国においては、no property ruleゆえ、コモンロー上も制定法上も、本人は自分の死後の死体に対しrequestができるのみであったが、同法案は、死体の保存や利用に関して、成人・子どもとも、appropriate consentを必要とするという法原理の大転換をはかっている点が注目される。また、Human Tissue Authorityという機関を新しく設け、人体利用に関する免許制度を導入するほか、監査のための組織も新しく設けることとしている。また、シンガポールの法案においても、人由来資料を用いる研究については、医療サービス庁長官の免許を必要とされている。わが国においては、ヒトES細胞を用いる研究を除いてはこれら研究に関する国の関与はない。このため、この現状を不十分とし、被験者保護法を作るべきだという主張がいくつかなされている。2年間の研究では、常に動き続ける諸外国における動きを把握するにとどまり、わが国においてあるべき規制のあり方についてきちんとした検討はできなかったが、今後の課題として、(1)研究はそもそも国・公(この両者の異同についても整理しなければならない)のコントロール下におかれるべきものか、(2)研究が国民からの理解を得て行われるためにはどのような体制が必要か、などをさらに検討していく必要があるものと思われる。
