项目摘要

1983〜84年に湖北省江陵県張家山漢墓より発掘された簡牘資料、とくに「二年律令」と標題の付された一連の冊書は、従来あまり明らかではなかった、前漢初期の法制・官制に新たな光を当てるものである。地方行政の末端である県・道や郷における行政手続きについても、二年律令では詳細に規定されている。ここでは県・道とその下に置かれた郷、および県・道を統括する郡の二千石官とを対象として、二年律令にみえる所轄事務の分担の様相を整理しておきたい。当時の地方行政の要務が、司法と徴税であったことはすでに周知の事実である。二年律令でも司法に関しては、犯罪告発の受理、断獄および請?、盗賊の捜索・逮捕が県・道の管轄とされている。また郷においては、放火犯の逮捕、貨幣偽造者の逮捕がその職務とされる。徴税に関しては、民衆からの芻稾の取り立ておよび使用、賦錢の取り立ておよび使用、徭役の免除などが県・道においてなされている。これらがいわば動産の管理とするならば、郷においては、道路の管理、田宅支給の手続、田宅所有者変更の手続きなどいわば不動産の管理がなされ、そして戸籍や民宅園戸籍・年細籍・田比地籍・田命籍・田租籍ほかの薄籍の作成と管理も郷においてなされる。当時の民衆支配においては、県・道とその下部機関である郷との間に何らかの所轄分担がなされていたと想定できるのである。また、少なくとも二年律令で見る限りは、県・道の上部機関である郡の二千石官の職務は、県・道からの断獄などについての上申の受付など、かなり限定的であり、当時の民衆支配の中心が郡ではなく、県・道であったことが窺われる。ただし、二年律令が当時存在していた全法令からの抜粋であった可能性は高く、墓主の生前の勤務地が県・道であったとするならば、上記のような民衆支配における県・道の比重の大きさは、かなり割り引いて見る必要があるだろう。
