本年度は、ドイツ・マックスプランク国際社会法研究所にて、現地研究者と、意見を交換する機会に恵まれた。本研究が対象とする「家族負担調整」あるいは「家族履行調整」という法概念を用いた育児支援政策に関わる法解釈論は、ドイツでも、研究者の関心事であり、多くの法学研究者が、この問題に関する研究に取り組んでいる。今年度の主な成果を以下に挙げる。まずはじめに、ドイツの議論とわが国の議論状況の違いとして、育児の給付客体としての捉えかたの相違がある。すなわち、従来のわが国の社会保障法学説上、育児は他の所得保障事由である疾病や失業などと同様に、単に給付事由に起因する経済的損失の補償事由にすぎないとされてきた。これに対してドイツでは「家族履行調整」という法概念を定立することで、育児が、単なる経済的損失補償事由ではなく、それを超えた、更なる補償事由を有することを明らかにする。それを超えた更なる補償事由とはすなわち、育児が有する対社会的効用の承認と、これに基づいた育児への報償である。このような考え方は同時に、配分政策において配分の機軸となる客体分類に、高所得者・低所得者、あるいは、高齢者・若年者という従来の分類とは別に、新たに子供のいる家族というカテゴリーが明示的に加わることを意味する。このように「育児」は固有の給付事由をもつ独立した給付客体であるゆえに、他の給付事由とは異なる規範的根拠ならびに、それのみを対象とする政策が必要とされるのである。わが国においてはこの点に関する共通の認識は、一部の社会保障法研究者(例えば山田晋「児童手当制度の展望」『講座社会保障法第2巻』(法律文化社2001年)287頁。)を除いて形成されていない。それゆえ本年度の研究成果の一つである社会保障法学会誌21号に投稿した拙稿において、この点を明らかにすると共に、上記の理解に基づくわが国の児童手当制度への示唆を論じたのは、非常に先駆的な試みであり、大きな成果である。
