本研究は、中国の裁判外紛争処理制度の一つである人民調停制度の利用を題材として、今まで好んで利用されてきた当該制度が、なぜ利用されなくなったのかを解明することを目指すものである。理論的、実証的に考察するため、本研究では、制度の分析と利用状況に関するデータの分析という二つの側面から、当該問題へのアプローチを試みてきた。当該制度は、建国前の革命根拠地において樹立され、建国してからは、それを規定する三つの条例が公布されてきた。それぞれの時期において公布された条例の比較を通じて、制度の設計者の当該制度に対する期待が変化していることが明らかになってきた。また、人民調停制度の利用についてのデータを分析する際、その対比軸に、民事第一審の利用データも整理した。整理した16年分の両者利用データの比較分析からは、調停から訴訟への移行を実証的に証明することができた。また、紛争類型別にみた利用データの両者比較からは、棲み分けの現象が生じていることも明らかになった。作業を進めるにつれ、制度ないしデータの分析では、制度設計者の狙いと、調停利用が減少している状況を把握することができた。また、「なぜ人民調停が使われなくなったのか」という本研究の課題にも一応の答えを出すことに至った。論文の内容について、講座内の論文報告会において報告をした。内容について若干の調整を加え、近々北大法学論集に投稿する予定である。
