项目摘要

この研究は、裁判外紛争処理手続(ADR)にオンライン技術を応用することによって、従来のものより効率的かつ質の高い、そして国境に制約されない紛争処理手続を構築することを目標としている。オンラインADRのメリットは、第一に遠隔地の当事者による利用を可能とすることで、弁護士などのリーガルサービス機関が乏しい、または全く存在しない地域の住民にも開かれた法的サービスを提供できること、第二にオンライン環境では紛争の特質に応じて、公開または非公開のそれぞれのメリットを最大限生かすことが出来ること、そして第三にサイバースペースで生じたトラブルの解決に馴染みやすく、その特性にマッチしたシステムを構築できることである。以上のような可能性を考慮して、具体的な実証モデルを構築するのが本研究の目的であった。本研究の第一の具体的作業として、法律相談をオンライン環境で行う実証モデルを構想した。具体的には、相談者の話から法的に整理するために必要な要素をいかに引き出すためのインターフェースを設計する作業であり、国内外のオンライン相談受付窓口のインターフェースを参考にしつつ、試作を行っている。次に、相談者の問題解決に役立つ法律や裁判例を提供するために、相談者が法律データベースにアクセスできる環境を構築した。本研究では具体的に法律データベースのLAN環境によるアクセス利用権を設定し、これに対する相談者のアクセス実験を行った。このほか、本研究の本来の目的はオンライン調停のシステムを構築することであり、そのためにアメリカでADRの研究者の意見聴取を行うとともに、電子メール等を通じた意見交換を進めた。今年度は、研究期間がごく短期間ということもあって、システムの基本的な部分の構築にとどまらざるを得ないが、来年度は、実際の紛争当事者や弁護士の協力を得て、グループウェアによる交渉の実験を行う予定である。
