違法表現と異なり表現の自由保障を享受するが、その受け手への影響を根拠にその青少年への提供には法的規制も許されると解されてきた有害な表現・情報につき、これがインターネット(以下「ネット」)を介する場合には、そのグローバル性ゆえの発信者規制の実際的困難性に加え、受信者選別の困難さによる表現の自由への萎縮的効果ゆえのその規制の理論的困難性をも伴うため、ネット上での青少年による有害表現への接触の機会が著しく増大している。そこで本研究では、(1)この問題への対応に先駆的なアメリカを比較法対象として、同国でのその法的規制の在り方を史的にも考察し、(2)わが国同様同国でも従来からその規制根拠とされてきた、有害表現と青少年の問題行動との間の因果性につき、表現の自由とその健全育成とを対抗的利益と捉えない視点からの検討を試み、これら存在立証の困難な因果性ではなく健全育成に対する保護者の権利という新たな規制根拠論の可能性を検討し、(3)この規制根拠論を前提に、規制手段論として、この利益の達成に適した規制の具体的在り方を考究してきた。その当面の結論としては、保護者による情報制御を可能にする技術の導入等の法的な支援・促進といった対応に妥当性が認められると考え、最終年度たる本年度も上記(3)に重点をおくべく研究中、本課題に係る現時点でのわが国における実務的事案処理として、他人の発した有害情報を放置する行為や、違法活用の可能性もあるがそれ自体は価値中立的な情報やデータ(例えばいわゆるWinny等のソフトウェアもこれに当たる)の発信者への規制も散見されたことから、本課題とも重要な関連をもち、かつその刑法学的検討も喫急と思われたこれらの論点につき「アメリカ形法における『中立的行為による幇助』」(金沢法学50巻1号(2007年)1-38頁)との論稿を著した。ゆえに本年度は本課題自体の業績を得なかったが、近い将来にそれを纏めたいと考える。
