项目摘要

◆昨年度に引き続き、企業倫理に関する文献の収集を行い、学際的な観点から企業の社会的責任について研究を重ねた。論文1本、学会報告3回、翻訳(共訳)1冊がその成果である。今年度、主に注目したのは企業形態とその責任との関係である。たとえば株主の有限責任や企業への法人格付与など、企業という概念に社会的な責任が帰属された経緯を企業形態の変遷とともに検討し、その背景にある論理を提示することに努めた。◆本研究の手法は学際的な観点から企業倫理を研究することにあり、商学・経営学、経済学、社会学、法学、倫理学など分野横断的に企業責任の概念を検討した。3つの学会・研究会での報告はいずれも、従来異なる文脈や学問体系で検討されてきた論点を学際的に総合することを目指したものである。ひとつに民間企業の慈善事業が株主の財産権の侵害や経営者の受託義務違反ではなく、社会的な義務として合法化された経緯を裁判記録とともに検討した。もうひとつに、企業は私的な存在としてビジネスを営むべきかのように語られるが、民間企業の私的な属性は公共性と対置される概念とはいえないことを述べた。そして、株主のためであれ社会のためであれ、企業の社会的責任は信託と義務という倫理的な概念に依拠して正当化されてきたことを指摘した。◆今年度刊行した論文では、ステイクホルダー理論に内在する力学について検討した。企業の社会的責任は株主の利益だけではなく、従業員や顧客や地域社会などの利害に配慮することを議論の土台として議論される。だがビジネスの利害を人々に与える利益と危害を論じ分けたうえで、その許容幅と禁止領域を言わなければ、企業の責任論にはならないことを結論付けた。また研究会を重ねた若手研究者らとともに、カントの義務概念にもとづく企業倫理の専門書を分担で翻訳し、刊行した。

This research approach is to examine the concept of corporate responsibility from the perspective of business ethics, business, economics, sociology, and ethics. 3. The report of the Society and the Research Institute is divided into three parts: the first part is the discussion of the subject matter, the second part is the discussion of the subject matter, the third part is the discussion of the subject matter, and the fourth part is the discussion of the subject matter. Private enterprises and charitable organizations violate the fiduciary obligations of owners and managers, legalize the obligations of society, and record and investigate the violations. The concept of the existence of private enterprises and the management of business operations is stated, and the concept of the private nature of private enterprises is public and opposed is described. The concept of trust and obligation is justified.◆ This year's issue of the paper is to discuss the inherent mechanics of the theory. The social responsibility of the enterprise is divided into the interests of the owner, the employee, the customer, the regional social interests, and the discussion. The interests and harms of enterprises are discussed in detail. The research association will focus on the responsibility of the researcher and the sharing of business ethics.
