本研究は、2001年の同時多発テロ以降、急速に厳格化するアメリカ合衆国の出入国管理法制に着目し、そこに存する二つの重要な憲法学上の課題(「外国人のデュープロセスの保障範囲と司法審査の可能性」と「出入国管理行政の透明性」)につき、相互の関連性を重視しながら考察することを通し、憲法学上の評価を行うことを目的としたものである。平成18年度に行った前者の課題に関する調査研究の成果を踏まえ、平成19年度は、後者の課題に取り組み、とくに合衆国政府の拘束下に置かれた外国人の情報に関する問題に焦点を当て、以下のことを行った。第一に、近年のアメリカのテロ対策に関連する情報をめぐる状況を調査した。その結果、テロ対策全般において政府の保有する情報が公表されない傾向が強まっていることが確認されたほか、テロ対策に関連する行政手続についても同様の傾向が確認された。第二に、合衆国政府の拘束下に置かれた外国入に関する情報及び手続の公開に関する裁判例の分析を行った。その結果、ほぼすべての事件においてテロ対策又は国家の安全に関わる分野における政府の判断に対する司法府の徹底した敬譲の姿勢が確認された。また、情報開示請求訴訟に限定しても、政府が国家の安全上の理由を主張して情報の非開示を求めた事件においては、政府側の主張がほぼ自動的に認められ、非開示が正当化されていることが確認された。第三に、当該問題に関する学説の調査・分析を行った。上記の調査及び分析結果をまとめた論文を執筆し、静岡大学紀要(法政研究)第12巻において発表した。
