项目摘要

本研究の２年目となる2022(R4)年度は、憎悪に基づく言動への法的対処に関する比較憲法学上の諸論点のうち、本研究の第１課題であるところの、人種等の集団に対する殺害や暴力の扇動表現の規制に関する研究に従事した。なかでもとくにジェノサイド扇動表現の規制に着目し、ジェノサイド条約の下でジェノサイド扇動表現を禁止する米国の連邦法（ジェノサイド条約実施法）に着目し、同法の制定をめぐって生じた憲法学上の議論を分析・検証したうえで、ヘイトスピーチ規制に関する日本の最高裁判例（最三判2022年2月15日）の判示内容をふまえつつ、日本法への示唆となる点を検証し、論文としての取りまとめ作業を行った（論文は2023年度刊行予定）。また、第２課題であるところの、米国の諸州における人種等の属性に基づく威嚇や嫌がらせの規制についての調査にも着手し、州法規定及び判例状況の調査を行った。両研究の成果としての論文は、次年度には刊行することができる見込みであり、これにより、日本国内の法整備をめぐる議論に一定の示唆を与えることができると考えている。なお、2022年度にはまた、日本の地方自治体条例に基づくヘイトスピーチ規制にも着目し、各自治体の条例を比較しつつ、とくに憲法上の議論の生じうる規定についての検証を行ったうえで、研究会等において意見交換等を行った。以上のとおり、2022(R4)年度は、論文刊行には至っていないが、研究自体は進展しており、翌年度の論文刊行の目処もたっていることから、一定の成果を出していると考えている。

In the year 2022(R4) of this study, we compared the constitutional issues related to the relationship between the basic speech and the behavior of violence. The first topic of this study was the research on the relationship between the behavior of violence and the behavior of homicide. The United States Constitution prohibits the use of force in connection with the use of force. The Supreme Court of Japan (Supreme Court of Japan, February 15, 2022) issued a judgment on the contents of the judgment, the examination and verification of the points of the Japanese law, and the implementation of the paper (scheduled for publication in 2023). The second topic is to investigate the status of the state laws and precedents in the investigation of the basic characteristics of the states of the United States, such as race, etc. The results of the research are published in the following year. For fiscal year 2022, Japan's local government regulations are based on regulations, regulations of each local government are compared, constitutional discussions are held, regulations are examined, opinions are exchanged, etc. For the above reasons, the 2022(R4) annual report, the publication of papers, the progress of research, the purpose of the next year's paper publication, certain achievements, etc.
