项目摘要

本研究の目的は、最低生活保障を求める憲法上の権利が有する規範的意義を、公的扶助と出入国管理という二つの分野の両面から明らかにすることである。本研究は5か年にわたり行われる予定であるところ、一年目の2022年度においては、以下のような研究実施計画を立てていた。すなわち、【課題①外国人と国民、および外国人間の給付の差異づけの根拠と許容範囲を明らかにする。】として、【課題①-1】主に立法資料の分析を通じて、ドイツの公的扶助法において、外国人と内国民、そして外国人間において、給付の差異づけがどのように行われているか、および、差異づけの根拠とその正当性を検証する。さらに、【課題①-2】主にドイツ行政裁判所と社会裁判所の裁判例を分析対象として、(1)ドイツ人に対しては法的請求権として認められる扶助の一部が、外国人には権利ではなく行政裁量により認めるとした規定の運用実態、および(2)非正規滞在者や入管法上の義務の違反者に対する減額規定の解釈・運用を明らかにし、当時の学説に照らしつつ、差異づけについての憲法上の許容範囲を示す。2022年度は、【課題①-1】および【課題①-2】について、それぞれ論文を執筆した。【課題①-2】にあたる部分の成果は、「『永住的でない』外国人の生活保護受給権―1980年代および1990年代のドイツを素材とした検討―」早稲田法学97巻4号(2022年)77-123頁としてすでに公刊されており、【課題①-1】にあたる部分の成果は、「ドイツにおける外国人の公的扶助給付の差異に対する憲法的統制の意義と限界─内外人平等と無保護のあいだ─」として、早稲田法学98巻3号(2023年)に公刊が予定されている。
