損害防止義務および損害防止費用負担義務の展開過程の解明が、本研究の最終的な目的である。平成18年度においては、英国での現地調査を含め、同国海上保険法にかかる立法資料、著書、雑誌論文および判例の収集・分析を行った。本年度は、昨年度の調査結果および資料の整理・検討を主として行ってきたが、そのなかで、まず、わが国の海上保険分野における先行研究から、損害防止義務および損害防止費用負担義務を規定する商法660条1項について、海上保険契約と非海上保険契約との間で、あるいは、両分野で展開されてきた解釈論に差異のないこと、しかしながら、その過去においては、海上保険契約において両義務が重要な論点とされ、海上保険生成史や当該法制史にかかる検討を含めた精緻な解釈学説が展開されていたことを実証した。加えて、わが国の当該分野に対する英国海上保険法制の影響力が絶大であること、したがって商法660条1項、なかでも損害防止費用負担義務を規定する同項但書の強行性如何を議論する上で、中世の商人法をコモン・ローが吸収して以降、判例法として発展してきた英国の海上保険法ならびに同国保険法制の、その形成過程を辿る歴史的研究が必要不可欠であることを論証した。併せて、2007年11月に開催された日本リスク研究学会において、「海上リスク対策としての損害防止義務」と題して報告、研究者に加え、保険実務関係者から貴重な意見を受けた。それらを踏まえ、1906年英国海上保険法を中心とする同国海上保険法制史への理解の必要性から、英国における同法の改正へ向けた昨今の動勢をも踏まえた上で、その制定過程から現在に至るまでの検討を行った。かかる成果については、「英国海上保険法制史、その素描-損害防止費用負担義務形成史にかかる序章-」として、損害保険研究70巻1号(2008年5月発行)に公表する予定である。
