本研究は, 国際私法上の性質決定の理論に関する研究に, 信託とその隣接法律関係(法人や代理等)の国際私法上の区別を素材として用いて取り組み, 当該理論の再構築を試みることを目的とするものである。平成25年度に実施した研究は下記の通りである。本年度においては, 前年度に遂行した序論的研究を基盤として, 日本国際私法上の信託の性質決定方法を明らかにする研究に取り組んだ。その成果については, 関西国際私法研究会(会場 : 大阪大学, 日程 : 平成25年4月27日)における報告を行った後, そこで得たコメントを基に発展させ, 国際私法学会の第126回研究大会(会場 : 中央大学, 日程 : 平成25年6月2日)において学会報告として公表した(題目 : 「信託の準拠法に関する考察―受益者保護の観点から―」, 形式 : 口頭発表)。また, この学会報告の成果に基づき, 同研究大会における質疑応答等で得たコメントや同学会の学会誌編集委員の査読を通じて得たコメントを反映させた上で, 論文を執筆・公表した(八並廉「信託の準拠法に関する考察―信託当事者間関係の多様化に着目して」『国際私法年報』第15号(2014年3月)195-221頁)。また, ケルン大学国際私法外国私法研究所における在外研究を適宜実施し, 本研究課題に関連する資料の調査を進めた(今年度にかかる在外研究実施日 : 平成25年2月27日～平成25年4月12日, 平成25年5月1日～平成25年5月14日, 平成26年2月16日～平成26年3月16日)。在外研究期間中には, 信託及びその隣接法律関係に関係する学説・立法例・裁判例を整理するために, ドイツ国際私法を中心として欧州国際私法に関する文献を収集・分析した。在外研究中, Heinz-Peter Mansel教授をはじめとする同大学所属の研究者から, 本研究に対するコメントを頂戴し, 本研究課題に関連する研究資料の提供を受けた。
