项目摘要

本年度の研究実績の概要は次の通りである。本年度は、まず、思想史的な視座から新体制期の憲法状況を検討した「新体制期における人権・主権の転換に関す一考察」(『歴史評論』第719号、2010年3月)を発表した。本稿では、近衛新体制期に人権・主権といった基本理の憲法の制約からの解放が帝国憲法体制の崩壊の契機であったことを、黒田覚と大石義雄、佐々木惣一などの京学派の国家総動員法、大政翼賛会をめぐる憲法論議の検討を通じて明らかにした。また、戦後憲法の成立による美部達吉の憲法学の転回については、「日本国憲法と美濃部達吉の八月革命説」(『人間社会学研究集録』第5号、20年3月)を発表した。本稿では、美濃部の帝国憲法改正反対の論理であった八月革命説がのちに日本国憲法を正当する論理に反転したのは、戦前からの国際法優位の一元論の背景にあった事実の規範説の影響が大きかったこと、た、占領軍の力を背景にした日本国憲法制定は、戦前日本では達成困難であった美濃部の政治構想(議会内閣制)図らずも実現させるものであり、そのことを自覚した美濃部は日本国憲法擁護へと主体的に転向したことを明らかした。さらに、近代日本における人権・主権の制約原理の特質と展開に関する総合的研究の成果として、「近代日の主権国家と生存権」(『人文学論集』第28号、2010年3月)、「大日本帝国憲法の基本理念と『生存権』」(『史学研究』掲載予定)を発表した。これらの研究では、主権・人権の特質と由来の考察を通じて、戦後憲法の基本理である基本的人権を準備した戦前日本の思想的土壌を明らかにした。
