项目摘要

本年度は最終年度のため、研究成果の取りまとめに多くの時間を費やした。静岡県伊東市池区の事例をもとに、市場経済システムを利用した形でのコモンズの維持、または市場経済システムと親和的なシステムとなるための法制度的工夫等の知見をまとめ、様々な学会へ投稿し、査読論文として受理され社会へ公表された。また、採択課題における研究の対象となる事例は、伊東市池区のような純粋に親和的な形態へと地域社会のシステムを変容させることのみを指すわけではない。一方で市場経済のシステムや原理・価値基準等に対し、地域社会におけるコモンズの原理を対抗させることで、市場経済システムの修正を促し、システムの持続性を担保し得る機能をコモンズは有しているとみることもできる。これは、山梨県南巨摩郡身延町で集落の入会地に最終処分場の建設計画が浮上したことによって生じた「入会権不存在確認請求訴訟」に見て取れた。このような日本におけるコモンズの典型例として認知されている「入会」の環境保全的機能については次第に社会に認知されつつある。このような「入会」の原理を「まちづくり」や都市における「生活環境や共同スペース」の保全的管理の手法として利用しようとする研究者も現れている。私は市場経済が人々の生活に深く浸透した都市社会においても、コミュニティを中心とした地域社会の共同的環境管理システムが構築され得ることを実証することを目指し、滋賀県長浜市のまちづくり・中心市街地活性化の取り組みを検証することで、都市社会におけるコモンズの有用性を明らかにした。これらの都市社会におけるコモンズの課題と展望については、東京都国立市の「国立マンション訴訟」を分析することによって、より法制度面からのアプローチを充実させ法学的な理論形成の助けとした。このような研究成果は今年度、学位請求論文『環境保全に寄与する「総有的所有観」の現代的意義』としてまとめた。
