本課題は、国連の安全保障理事会(安保理)による私人に対する権限行使がいかなる法的規制に服しているのかを明らかにするものである。本年度は、(1)対私人権限行使が拡大した法的及び政治的背景を明らかにした上で、(2)主要な対私人権限行使の具体的実行を調査し、(3)各権限行使の法的根拠及び手続きの合法性に関して検証を行った。また、(4)対私人権限行使の正当性についても研究を進めた。(4)の点については、まだ理論的検証が不十分であり、平成23年度の中心課題の一つに据える予定である。上記4点の研究は、主として先行研究及び国連文書の検証を通じて行った。これらに加えて、今年度は、平成22年8月末から平成23年度3月末まで、ニューヨーク大学法学研究科の国際法研究所の客員博士研究員として在外研究を行い、同研究科・研究所内の国連・国際機構法の専門家と意見交換を行った。また、安保理の制裁委員会に携わる専門家、国連職員、及び米州機構等の地域機構の高官に対してインタビューを行い、国連文書からは得ることの出来ない情報や見識を得ることができた。具体的成果としては、上記項目(3)及び(4)の検証の一環として、国連安保理の権限行使に対する司法審査を検証した論文(日本語)を公表した。また、非国家武装集団に対する安保理の権限行使に関する法的及び政治的諸問題に焦点を当てた論文(英語)は、アジア国際法学会の若手研究者ワークショップ(平成22年9月)で報告し、公表予定である。
