Policy Formation Process and Pragmatic Approach to IntellectualProperty Law and Policy

使用“知识产权”作为隐喻有两种可能的方式。前者将知识产权法理解为对“智力作品”提供保护的方式，后者将知识产权法理解为“调节人类活动”的方式。我们认为后一种方法是可取的。如果采用这种方法，那些主张加强知识产权保护的人将不得不提供更有说服力的论据，这将支持这种保护，并将导致受管制实体将其内部化。因此，隐喻的选择显著影响了知识产权制度设计过程中“蒙混过关”的整体过程。

There are two possible ways of using "intellectual property" as metaphor. The first approach sees intellectual property law as the way of providing protection to "intellectual works", and the second one understands intellectual property law as the ways of "regulating human activities". We argue the latter approach is recommendable. If this approach is adopted, those who argue for strengthening intellectual property protection will have to provide a more persuasive argument, which will support such protection and which will lead to its internalization by the regulated entities. The selection of metaphor thus significantly affects the overall process of conducting "muddling through" during the designing an intellectual property regime.
