The purpose of this study was to clarify the American constituent power theory in the 18 century comparison with contemporarily constituent power theory. Main findings were as follows:1) There was the sharp line between the Constituent power and legislative power in the colonial period.2) During the establishing Constitution of the Commonwealth of Massachusetts, many town demanded constitutional convention distinguished from legislative power.3) I found a historical development of Japanese constituent power theory.

本研究的目的在于厘清美国世纪的宪法权力理论与当代宪法权力理论的比较。主要发现：1）殖民地时期，立宪权与立法权之间存在着明显的界限; 2）在马萨诸塞州制宪过程中，许多城镇要求区别于立法权的立宪惯例; 3）日本立宪权理论的历史发展。
