今年度は,南京国民政府時期（1928～1937年）の刑事訴訟法改正の背景について研究を進めた。具体的には,①南京国民政府時期の検察制度についての論文を執筆し，②同時期の自訴制度（私人訴追制度）についての学会報告を行った。①について，拙稿「1930年代前半の中国における検察制度」が『歴史学研究』944号（歴史学研究会，2016年4月20日発行，査読あり）に掲載される見込みとなった。また，拙稿「南京国民政府時期地方法院検察官與司法警察」（中国語）が胡春恵・劉祥光主編『2014両岸三地歴史学研究生研討会論文集』（台湾：国立政治大学歴史学系・香港：珠海学院亜州研究中心，2015年11月，査読あり）に掲載された。ともに,統計史料や裁判記録等の一次史料を駆使し,近代中国における検察制度の成立の意味について考察したものである。日本と台湾の両地域で論文を発表できたことは大きな成果であった。②について，法制史学会第67回総会にて，「南京国民政府時期における自訴制度」という題目で報告を行った（2015年6月15日，関西学院大学）。近代中国の法制改革において重要項目の一つとされていた被害者訴追制度の整備について,立法過程と法律運用の実態を総合的に分析することで,その背景を考察した。さらに,①と②の分析結果を総合することで,20世紀前半の中国において,国家訴追と私人訴追を併用する訴追制度が成立したことの意義を考察し,博士論文の完成に向けて大いに前進した。

This year, the background of criminal procedure law correction during Nanjing National Government (1928~1937) is studied. Specifically,① the inspection system in Nanjing National Government period was written, ② the private prosecution system (private prosecution system) in the same period was written. 1."The Inspection System of China in the First Half of the 1930s," published by the Historical Research Society on April 20, 2016, No. 944. The historical materials of statistics and judgment records are used to investigate the establishment of inspection system in modern China. Japan's Taiwan region is the most important place to visit. 2. Report on the topic "Private prosecution system during the Nanjing National Government" at the 67th Conference of the Legal History Society (June 15, 2015, Kansai Gakuin University). An analysis of the important items of legal reform in modern China, including the preparation of the victim's lawsuit system, the legislative process and the application of law. In the first half of the 20th century in China, the system of state litigation and private litigation was established.
