项目摘要

2022年度は、九州法学会2022年度（第127回）学術大会（令和4年6月18日、於九州大学）において、「ドイツ連邦憲法裁判所における責任主義」を報告し、その後の質疑応答を踏まえて、同名の論文を会報誌において公表した。報告および論文においては、ドイツ連邦憲法裁判所における責任主義への言及を整理し、その前提となる責任主義のイメージを具体化させることにある程度成功した。ただし、そこでの責任主義への言及は、憲法上の法的根拠の論証も含めて、きわめて多義的であり、その意味内容および法的位置付けを明確にすることは非常に困難であることも確認された。したがって、今後は、より理論的な研究を深めるとともに、ひるがえってドイツ連邦憲法裁判所のテキストを再解釈する必要性があるということが明確になった。さらに、ドイツ連邦憲法裁判所のテキストの分析からは、刑事手続における真実概念や権利保障の議論が責任主義の理念と密接に関係していること、この点に関する先行研究がほとんど存在しないことが明らかとなった。20世紀前半のドイツにおける規範的責任論の展開については、調査の結果、先行研究を超えるだけの成果が得られる見込みは少ないことが確認された。むしろ、19世紀前半の近代刑法の成立段階における責任概念からの大きな流れの中で、規範的責任論がどのような意義を持っていたのか、それが現在、たとえばドイツ連邦憲法裁判所における責任概念の理解にいかなる影響を及ぼしているのかを論じる方が有益であると現在では想定している。また、次年度以降の研究の準備として、ヘーゲル学派刑法学における刑罰・責任概念の理解およびその問題点や、近年の「責任と応答」をめぐる諸論稿に関する予備調査を行った。
