项目摘要

本研究においては、フランス法におけるayant cause概念の意義を明らかにすべく、同概念と密接な関係に立つと考えられるところのrepresentation概念の意義について検討を行なっている。本年度は、前年度に引き続いて、詐害行為取消請求を行った一般債権者が他の債権者をrepresenterしているという１９世紀フランス法における有力な理解についてその理論構成を検討し、行使されている詐害行為取消権の共通性が重要な意義を果たしているのではないかという点を明らかにした。このことは、フランス法において、ある権利義務Aの当事者が他の権利義務Bの当事者をrepresenterするという場合について、権利義務Aと権利義務Bとの間にある一種の共通性が大きな意味を持っていることを示唆している。というのも、フランス法においては、権利義務Aが存在するということは誰に対しても通用するのであり、権利義務Bの当事者にとっても権利義務Aの存在は、存在として認識されるべきものである。つまり、権利義務Aが存在することそれ自体が権利義務Bの存在と連動しているという場合においては、権利義務Aと権利義務Bとは共通の要素を持っているのでなければなければならず、その共通性ゆえに、権利義務Aの当事者と権利義務Bの当事者とは同一の立場に置かれているとも言いうるわけである。権利義務Aの当事者が権利義務Bの当事者をrepresenterするということの意義はまさにこの点にあると考えられ、今後はこの仮説を実証的に検討していく予定である。
