项目摘要

本研究の目的は、国内課題だけでなく地球規模課題への効果的対処も視野に入れ、時間（クロノス）の視座に空間（トポス）の視座を統合することで「時空間（クロノトポス）」の視座から世代間衡平に資する新たな法システムを探求することである。研究計画の初年度である2022年度は、研究計画の第一段階である「租税法・財政法の時空間構造の理解更新」として行動洞察による事実解明的分析を遂行した。具体的には、行動経済学の知見を援用しつつ、租税法・財政法の法制度及び法理論について時間軸及び空間軸の観点から体系的・包括的な理解の更新を試みた。加えて、研究計画の第二段階である「租税法・財政法の時空間的拡張」として上記第一段階での作業を踏まえた形での規範的分析の準備作業を進めた。研究構想及び研究成果の一部を19th Asian Law Institute Conference(2022年5月29日、オンライン開催、主催：東京大学)において"Tax and Fiscal System in the era of COVID-19: From the viewpoint of　Intergenerational Equity and Interregional Equity"と題する英語論文を提出した上で、同論文に基づく研究報告を行った。そこでは、感染症対策など地球規模課題の問題を解決するために、ワクチンを広い地域に同時期に提供することが効果的である場合、将来の各国による法的拘束力のある寄附誓約を基礎に、国際機関が債券を発行することで財源を調達する取り組みを、世代間衡平と地域間衡平の交錯事例として分析するとともに、日本を含めた各国の財政赤字の問題について世代間衡平だけでなく地域間衡平からのアプローチも必要である旨の報告した。

The purpose of this study is to explore a new method for integrating time-space and intergenerational balance between visual field and temporal space.
