近代国際法は国家を単位として観念される法秩序である。近代国際法については立法機能や司法機能の不完全さについての批判もあるが、より根源的な批判として、国家を単位とすること（「近代国際法の国家中心性」）についての批判がある。近代国際法の国家中心性の現実的な意義は、すべての国家に完全な法主体性を認め、国家以外のアクター（個人や非国家団体、非承認国家など）には国家が認める限りでの限定的な法律行為能力しか認めないという点にある。国家と非国家の峻別こそが、その本質である。ヨーロッパにおいて近代国際法が確立されたのは19世紀のことであり、国家中心主義は永遠不変の原理ではない。今日、近代国際法として観念されている国家間の様々な権利義務関係が突然に消滅することはないが、それを近代国際法の一部として理解する観念体系が、ある時期に急に別の観念体系に取って代わられることはありうる（国際関係の法的構成原理の転換）。本研究の目的は近代国際法の正当性の喪失をめぐる最新の議論に対し、東アジアの歴史と現状を踏まえて理論的な貢献を為すことにある。本年度は、2023年3月にロンドンの公文書館で主に19世紀の外交史料を収集するなど、資料・史料の収集と整理に努め、中間的な成果物としての原稿の準備を進めることができた。2022年9月には日本国際法学会の年次大会で、英文で"Universality and Europeanity of the Modern Delimitation of Territories"との題目で報告を行い、2023年3月に、その後に原稿を整理して、『Japanese Yearbook of International Law』に寄稿したところである（現在査読中）。他方で、現下の国際情勢の最大の課題であるウクライナ侵攻について、1990年代のコソボ紛争との関係で考察を深め、法律時報1185号（2023年1月）に「領域国際法の不確定性とコソボ紛争の余韻」との小稿を発表した。

Modern international law is the legal order of the state. Modern international law is characterized by its incomplete legislative function and its incomplete judicial function, as well as its criticism of the root cause and the position of the state ("state-centricity of modern international law"). The significance of state-centricity in modern international law includes the recognition of the complete legal subjectivity of the state, the recognition of the limited legal capacity of the state outside the state (individual, non-state entity, non-recognized state), and the recognition of the state. The state is not the state's absolute nature. Modern international law was established in the 19th century, and state-centrism never existed. Today, modern international law is a part of modern international law, which is concerned with the sudden elimination of relations between states and obligations.
