My doctoral project deals with the political authority of the European Union, hence the legitimacy conditions for its right to rule. It is divided into two main parts.In the first part, I intend to analyze nature and scope of the particular authority claim of the EU as a supranational polity, ie how it situates itself between state sovereignty and the authority of international organizations. The chosen criteria for this inquiry are institutions, membership and territory.In the second part, I expound the appropriate theoretical benchmark for judging this right to rule by drawing on political authority and obligation literature. Finally, I will judge the EU against this standard and thereby explain extent and limits of the EU's authority.The overall objective is to further our understanding of the EU's authority and thereby to trigger a discussion of the conditions for rightful rule in a non-statist supranational polity.2. Research ContextMy research aims to contribute to the growing literature on the Philosophy of the EU. Surprisingly, a comprehensive account of justifying the EU's authority or the appropriate basis for a moral obligation to obey EU law is still missing. Seminal discussions in surrounding areas, such as the social legitimacy of the EU or the EU's relation to sovereignty, have hitherto neglected this salient set of questions.My particular contribution will be to offer an account for the legitimate authority of the EU in order to stimulate a discourse on the conditions and limits for rightful rule in today's Europe. For the reach of the EU and its law becomes ever wider and its authority claim expands ever more into sensitive areas of policymaking. Thus, EU scholarship needs to discuss under what conditions this authority claim can be reconciled with individual autonomy and state sovereignty, to separate yet interrelated bedrocks of post-Enlightenment authority theory.3. MethodologyMy methodological approach combines doctrinal analysis of EU constitutional law on the one hand, and political theory (by developing a theoretical framework for the supranational manifestation of political authority) on the other. This combination serves to understand the theoretical nature of the EU, while closely reflecting the underlying social and legal reality. Whereas one has a reasonably good understanding of what states do - including ample theoretical arsenal to describe it - the same cannot be said about the EU as a sui generis polity. For example, the authority claim of the EU - amongst others - has been described as 'late sovereignty', 'quasi-national authority'. I try to put flesh to the bones of such terminology instead of restricting myself to simple labelling.
