Examimation of legal system of ewploymemt security focusing upon restrictions on dismissals in Japan

关于这一主题，研究的主题和在研究期间所做的结果如下。这是一个与劳动法覆盖范围相关的话题。通过本课题所获得的认识是，要使劳动法律的适用范围不再局限于有雇佣关系的劳动者，而要使各类劳动者的需求相对应，就必须对劳动法律本身进行重组。“关于劳动供给合同的备忘录，类似就业与劳动法”和“就业形式多样化与劳动法”是本研究的初步成果。这是对2003年《中华人民共和国刑法》修正案所伴随的立法课题的研究和考察。《劳动基准法关于解雇限制和固定期限合同规定的修改意义与问题点》就是这些研究课题的根本成果。其中，“自由裁量工作制”和“日本白领工作时间制”是对《劳动基准法》关于自由裁量工作制修改研究的成果。这是一项与企业组织转型相关的劳动法研究课题。本课题的初步研究成果是《日本劳动力市场和企业组织的变迁与劳动法》。

Concerning this theme, subject of study and the result which do during this research period are as follows.1. It is the topic which is related to the coverage of labor law. The knowledge which is obtained with this topic making the needs of the various workers correspond without the former way limiting the scope of application of labor law to workers with employment relation was that it is necessary to reorganize labor law itself. "The memorandum regarding labor supply contracts similar employment and labor law" and "Diversification of employment forms and labor law" are the elementary results with regard to this study.2. It is the research regarding the legislative topic which accompanied the amendment of in 2003 and examined. "Meaning and problematical point of the amendment of Labor Standard Law concerning restrictions on Dismissals and regulations on fixed-term contract" is a fundamental result with these subjects of study. And, "Discretionary work system" and "Working Hour Schemes for White-Collar Employees in Japan" are results with the study for the amendment of Labor Standard Law concerning discretionary work system.3. It is the research regarding the topic of the labor laws which are related to the transfiguration of enterprise organization. The elementary research result in this topic is "Transfiguration of Labor Market and Enterprise Organization and labor law in Japan.
