项目摘要

当初の研究計画では、2021年度は、ゲノム編集と同様の論点を有する、着床前診断やドーピングをめぐるドイツの議論状況の整理を行い、2022年度にドイツにおけるゲノム編集をめぐる議論状況の整理を行う予定であった。しかし、コロナ禍やスケジュール上の問題により、現地調査や資料収集が難しかったことから、計画を変更し、2021年度に予定していたゲノム編集に関するドイツの議論状況の整理も含めて、すでに入手できている資料の精読・検討を行って、2022年度に着床前診断やドーピングの議論状況も並行して整理することとした。2022年度の主たる研究成果としては、着床前診断とゲノム編集をパラレルに検討したことで、以下のような結論に至った点を挙げられる。ドイツにおいては、2011年の胚保護法改正により、着床前診断が、重篤な遺伝病の回避や染色体異常による流産・死産の回避の場合に、公的倫理員会の審査を経たうえで認められるようになったことが、ゲノム編集一部許容の根拠の一つとなっている。両者をパラレルに考えるのであれば、産まれてくる子どもんの重篤な遺伝病の回避や、染色体異常による流産・死産回避の場合にはゲノム編集を認める余地があり、着床前診断同様、遺伝病と関係のない単なる性選別や救世主兄弟、エンハンスメントを目的としたゲノム編集は認められないこととなろう。また、着床前診断と同様に、ゲノム編集についても公的倫理委員会が可否を判断したうえで行うというプロセスも考えられうるが、何をもって重篤な遺伝病とするのか、着床前診断に関しては、倫理委員会の判断にブレが生じているという実態があり、倫理委員会の審査結果を不服とした訴訟も相次いでいる。ゲノム編集についても同様の審査体制を設けるのであれば、こうした問題への対処の在り方を検討する必要がある。

In case of chromosome abnormality, abortion and stillbirth avoidance, there is room for compilation and recognition. In case of pre-implantation diagnosis, the same as in case of genetic disease, the relationship between genetic disease and the relationship between genetic selection and savior brother, the purpose of compilation and recognition. The Ethics Committee shall determine whether the pre-implantation diagnosis is relevant and whether the review results of the Ethics Committee are not satisfactory. It is necessary to discuss the problems and problems in the compilation of the same review system.
