誰一人取り残さない共生社会、誰にとっても安心安全な社会の構築に向け、障害を有する者が違法行為後においても、社会の中で受け入れられる、再犯防止に資する社会内処遇制度のあり方について検討してきた。研究の柱となる方向性としては、次の3点である。①障害を有する者に関する刑事司法の入り口の問題の検討、②触法精神障害者の施設処遇の長期化して、社会復帰が円滑に進まない問題の検討、③刑事司法の中で、いわゆる矯正処遇における精神障害等の処遇の問題の検討、である。そこで、①について、「入口支援」の現状に関し、特に四国内を中心に検討し、四国の特徴と比較するため、他の地域との比較を行い問題点を検討した。入口支援とは、違法行為を行った、障害等配慮を要する者に対して、刑事司法の入口段階で支援し、刑事司法の枠組みに入れることなく社会内での生活を維持できるようにするものである。さらに、②については、触法精神障害者の処遇を定める医療観察法において、入院が長期化して社会復帰が阻害される要因について、実務家から聞き取り調査を行い、スムーズな社会復帰のために必要な支援を検討し、また、措置入院退院後の社会復帰について、自治体等における試みについて検討した。③2022年に刑法が改正されて、刑務所での処遇に改善更生の視点が重視されるほか、知的障害者の処遇についての問題、について検討した。さらに社会内処遇の先進的な試みを行うことで知られるオランダでも、刑事司法の枠内での、精神障害者の処遇について調査を行った。
