项目摘要

領邦のポリツァイ形成への臣民の関与という本研究の関心にとって、神聖ローマ帝国の臣民が帝国レベルの裁判所を利用することができたということは重要である。帝国レベルを含めて臣民の働きかけを検討し、日本法制史学会第73回大会シンポジウムにおいて「帝国最高法院における魔女：名誉棄損訴訟の利用可能性の考察」として報告した。この報告では、刑事としての魔女裁判ではなく、民事としての魔女名誉棄損訴訟に着目した。名誉はヨーロッパ伝統社会において不可欠の社会資本であり、名誉棄損に関する規定は古代から存在する。この種の訴えには領邦・都市の世俗の下級裁判所や教会裁判所から、帝国レベルの裁判所まで、幅広い裁判所が管轄権を有している。このような管轄の重複はどの裁判所を利用するか、臣民に選択の余地を与えていたと言える。本報告で取り上げた事例では、トリーア選帝侯ヨハン7世は中傷被害者からの請願を受け彼を一貫して支持したが、選帝侯の姿勢と裏腹に、トリーア高等裁判所は魔女裁判史料の開示を拒否するなど、選帝侯が代官や高等裁判所に行使しうる影響力は限定的だった。こうした状況において、帝国最高法院への提訴は原告個人の権益を守るためのみならず、選帝侯にとっても領邦の司法の主導権強化という意味を持ったと言える。ほかの事例では、帝国最高法院訴訟は和解を前提とした時間稼ぎ、下級審の判決執行の先延ばしとも思われる訴訟が見られた。こうした訴訟は、領邦裁判所における判決や上訴抑制のための規定を形骸化するものともいえる。こうしたポリツァイの形成・解体という逆方向への働きかけを分析するうえでも、引き続き帝国レベルを含めた分析を進めていかなければならない。なお、本報告は論文として2023年度中に出版予定である。

This study is concerned about the use of the courts of the Holy Empire by the subjects of the Empire. The 73rd Conference of the Japanese Society of Legal History,"The Supreme Court of the Empire: An Investigation into the Possibility of Using the Litigation of Reputation" This report, criminal and civil, is a lawsuit against the witch for her reputation. The reputation of the system of social capital can not be owed, reputation of the relevant provisions of the ancient existence This kind of lawsuit has jurisdiction over the lower courts of the state, the city, the church, the empire, and the middle court. The jurisdiction of the court is repeated, and the subject is elected. This report takes examples from the above, such as the election of the emperor, the petition of the victim, the consistent support of the emperor, the attitude of the emperor, the refusal of the high court to disclose the historical data of the witch judge, the influence of the election of the emperor and the high court, and the limitation of the influence. The Supreme Court of the Empire filed a complaint against the plaintiff's personal interests, and the electorate's judicial dominance was strengthened. The Supreme Court of the Reich has decided to settle the case before the court, and the lower court has decided to postpone the execution of the case. The Court of Appeal and the Court of Appeal shall not be liable for any loss or damage arising out of or in connection with the proceedings. This is the first time I've ever seen a woman. This report is scheduled for publication in mid-2023.
