项目摘要

本研究は、インドネシアにおけるABSの実情を把握し、同国マイノリティの権利保護に関する法整備支援を実施することを目的とする。そしてその実現のため研究計画を大きく4つの段階に区分している。すなわち(1)現行の遺伝資源ABS関連法令および法案の分析並びに研究対象分野における最新情報、最新動向の獲得。さらに同国の先住民社会をめぐる法的問題点の抽出・分析、次に(2)環境林業省をはじめとする関連省庁へのヒアリング、さらに(3)先住民社会また関連するNGOへのヒアリング、そして最後に(4)集積データの分析と法整備支援（政策提言）である。昨年度まではコロナパンデミックの影響を真面に受け、現地への渡航がかなわず(2)～(4)のプロセス実施が困難であったことに鑑み、主に(1)の関連法令分析作業を継続して実施した。具体的には、環境の保護及び管理に関する2009年法律第32号、生物多様性に関する条約の遺伝資源取得の機会及びその利用から生じる利益の公正かつ衡平な配分に関する名古屋議定書の批准に関する2013年法律第11号、動植物種の保存に関する1999年政令第7号、動植物種の利用に関する1999年政令第8号、外国の大学、外国の研究開発機関、外国の法人及び外国人による研究開発活動の許認可に関する2006年政令第41号、自然保護区域及び自然保全区域の管理に関する2011年政令第28号、野生種遺伝資源取得の機会及びその利用による利益配分に関する2018年環境林業大臣規則第P2号、作物遺伝資源の保全と利用に関する2011年農業大臣規則第37号、及び、園芸種子の輸出入に関する2017年農業大臣規則第5号をその分析対象とし、これら同国遺伝資源ABS制度についての各種関連法令の内容、成立過程等の理解を昨年度は一層進めた。さらに同国カウンターパートであるガジャマダ大学法学部スタッフとこれらの内容を共有し、今後の研究計画の実施に向けて動いている。

The contents of the Law Department of the University of China are shared and the implementation of future research projects is carried out.
