本研究の目的は、被災者の権利に関する人権条約上の被災国の義務の視点から、被災国の同意原則を乗り越えるための理論的な枠組みの再構築を試みるために、次の2点を明らかにすることである。すなわち、（1）防災と国際的な災害対応をめぐる国際的な動きを中心にして、「国際災害法」という法体系が国際法の一体系として形成されつつある過程を実証的に解明することと、（2）被災者の保護と被災国の同意原則に関する概念、原則、及び規則の内容を明らかにすることである。（1）では、19世紀後半から現在までの「国際災害法」に関する法規範形成の過程を、行為体と成果物の2つに着目しながら分析する。（2）では、（1）で検討の対象とした成果物の分析とともに、被災者の保護に関する人権条約の規定の解釈や人権条約機関の実行等の分析を行う。令和4年度には、（2）の研究の中の被災者の保護に関する概念を明らかにするために、「市民的及び政治的権利に関する国際規約」（自由権規約）をはじめとする主要な人権条約の規定の解釈と条約機関の実行の検討を行った。その際、公衆衛生上の緊急事態と核廃棄物等に起因する環境損害も検討の対象に含めて分析を進めた。前者に関しては、自由権規約委員会の「一般的意見36」の26項と62項を解釈の資料として用いながら自由権規約2条と6条1項の解釈を行った。その結果、Covid-19のような「国際的関心事である公衆衛生上の緊急事態」が、同一般的意見26項で示された「社会の一般的な状況」の中に含まれると解することに妥当性があることを示すとともに、国家が取るべき措置の内容を明らかにした。後者に関しては、核廃棄物処理と管理が被災者の生命に対する権利に及ぼす影響と、同権利に関する国家の積極的義務について、国際環境法上の国家の義務と災害リスク削減の観点も含めて検討を進めた。
