项目摘要

2021年度は、オーストラリアメルボルン大学のStacey STEELE准教授と長年の共同研究を経て弘文堂にて『オーストラリア倒産法』（2022年1月）を出版させていただきました。本書は、オーストラリア倒産法の全体像について紹介したのみならず、近年のオーストラリアの倒産法改正でクローズアップされており、日本の解釈論・立法論上も重要な問題となっている争点事項に分析・検討したものであります。２０２１年度の研究成果を踏まえた上、その延長として、2022年度は、中国最高裁判所の裁判官で、中国の個人倒産法草案作成の責任者である方の執筆依頼を受けて日本の個人倒産に関する裁判例の六つの評釈、オーストラリアの個人倒産に関する五つの裁判例の評釈を執筆し、同年度末に中国の権威のある出版社である法律出版社に提出しました。これは、本という形で２０２３年度に出版される見込みであります。これらの裁判例は主として免責と財産権保障、免責事由、非免責債権、管財人、免責の効果、破産財団の範囲等に関するものであります。このうち、本研究課題と特に関連性が強いのは、免責の効力（国内外の効果）、破産財団の範囲（属地主義か普遍主義か）の問題です。これらの問題は国際倒産領域でも重要な課題となっており、中国、日本、オーストラリア法における裁判例を通じて関連問題の立法、解釈、実務について詳しく考察することは、日本の解釈論上、立法上同様の問題を考える上で重要な意義を有するものと思われます。
