项目摘要

近年,循環型経済の実現に向けた企業の自主的取組みが活発化している。本研究の目的は,自主的取組みに積極的な企業と消極的な企業の公平性の確保,企業と他の主体(特に,行政やNPO)との協働形式に焦点を当てて,自主規制と法的規制の組み合わせが有効に行われるための条件を提示することであった。そのために,平成10年度は,自主的取組みの形式として自主規制を多用しているドイツとの比較検討を行った。その結果,ドイツでは(1)各業種ごとの業界団体およびその上部団体であるBDlの組織力が強いこと,(2)そのため,自主規制には,通常,関連分野の多数の企業が参加しており,フリーライダーが発生する可能性が相対的に低いこと,(3)自主規制といっても,所轄庁との間に綿密な事前調整が行われたり,所轄庁への自主規制文書の提出がその発効要件とされるなど,行政との関係が深いこと,(4)自主規制における行政の影響力は,より厳しい法規制の可能性により担保されていること,などの知見が得られた。これに対し,日本では,(1)廃棄物処理業界に見られるように,業界の組織率が必ずしも高くないこと,(2)ISO14001の認証取得や,ゼロエミッションへの取組みが広がってきてはいるものの,これらはなお,各企業の担当者の環境意識に依存するところが大きいこと,などの特徴が認められる。それ故,ドイツと異なり,日本では,自主規制のみでは悪質事業者の改善につながらないと考えられる。今後は,廃棄物,地球温暖化などの個別的な課題について,自主規制の有効性と限界を具体的に検討していきたいと考えている。

In recent years, the circular economy has been realized, and the independent organization of enterprises has become active. The purpose of this study is to ensure the fairness of enterprises and other entities (special, administrative, NPO) and cooperation forms, and to prompt the combination of autonomous regulation and legal regulation. In 2010, we conducted a comparative study on the form of autonomous organization and autonomous regulation.
