项目摘要

本研究は、マーストリヒト条約による欧州統合の進展が欧州連合加盟諸国(とくにドイツ)の憲法秩序にどのような影響を与えているのかについて解明しようとするものである。本年度は、先ずヨーロッパ市民権の発展と現状について検討を加え、特にEU市民に対する地方選挙権の付与に伴う国内法の整備に関わる諸問題を考察した。その成果の一部は、論文「EU市民の住民投票への参加の合憲性」において公表した。この論文はEU市民がマーストリヒト条約によって保障された地方選挙権に加えて、各地方公共団体の実施する住民投票に参加することが憲法上許容されるかどうかに関するドイツの学説の動向を明らかにするものである。さらに、本年度はマーストリヒト条約によって導入された経済・通貨同盟の法的構造および欧州単一通貨の導入が国内の憲法秩序に与える影響について検討を加えた。その成果の一部は、論文「欧州通貨同盟と国家主権」において公表した。この論文は、欧州単一通貨の導入により通貨高権に関わる諸権限が加盟国から欧州共同体に移譲された結果、加盟国は通貨政策権限を失うが、こうした権限の喪失が加盟国の国家主権を侵害することにならないのかという論点について一定の解答を与えたドイツ連邦憲法裁判所1993年10月21日判決を考察したものである。そして、この論文では、連邦憲法裁判所がドイツの「国家性」(国家主権)を保持するために、EU条約およびその附属議定書についてかなり強引な解釈を施したことが明らかにされた。
