Judicial Precedents and Case Law in the First Half of Edo Period

本研究有两个目的。一是尽可能多地收集江户时代前半期（1742年以前）德川幕府的判例，二是考察这一时期判例法形成的某些方面。其中一个是收集19本《押置不乱》，这是唯一一本在1717年大火中幸免于难的《兵书》。另一个是发现了《京巴津洲八水》，它是根据《鹿鸣记》和《玄书》的记载，从《鹿鸣记》的先例中整理出的另一本《玄书》。一是从刑法史的角度，发掘出18个“片内”（对敌人的报复）和“巨内”（对妻子的敌人的报复）的案例，并揭示这些法律的制度。二是从私法史的角度，对”相互支付法“中的“主讼”与“金钱讼”的区分进行了界定。此外，还披露了哈佛法学院图书馆收藏的20世纪30年代中期的日本档案。

This study has two objects. One is to collect judicial precedents of Tokugawa Shognate in the first half of Edo period (before 1742) as many as possible, and the other is to investigate some aspects of forming case law in this period.With regard to the first object, I obtained two good results. One is collecting 19 copies of "Oshioki-burui" , which was the only Hyojosho precedens saved from burning in the fire of 1717. The other is discovering "Keibatsushu-bassui" , which is another copy of "Oshioki-saikyocho" and "Genshoshu" compiled from "Ro-cho" precedents of Machi-bugyosho.Regarding the second object, my research has proved also two successful fruits. One is, concerning the history of criminal law, to discover 18 cases of "Kataki-uchi" (revenge against enemies) and "Megataki-uchi" (revenge against wife's enemies) and bring those legal system to light. The other is, concerning the history of private law, to define the separation of "Hon-kuji" (main suits) and "Kane-kuji" (money suits) with respect to "Aitai-sumashi-rei" (mutual payment acts).Moreover, in connection with this research, I disclosed the details of Japanese archives that Harvard Law School Library stored up in the middle of 1930's.
