Common European Private Law of the Natural Person

The application proposes funding of a comparative law project on the law governing the natural person within the jurisdictions of the European Union. It is a project restricted to private law which, however, is in this area in manifold aspects influenced by developments in international, European and national human rights law. Private law of the natural person encapsulates the rules which enable human beings to participate in the benefits of private law. It is jus cogens, and it covers capacity in all its variety, the law against dispositions over the individual's body and dignity, the person's gender and his or her name. European private law has up to now concentrated on issues relevant to the proper functioning of the Internal Market. The project wishes to add to European private law a personal, so to speak a "humane" dimension.
