项目摘要

研究課題について次の三つのテーマを設定して研究を進めた。1.ヨーロッパ共同体(EC.現在はEU)における保険の自由化について、ヨーロッパ共同体加盟諸国は保険における共同市場を実現するため、営業の自由(preedom of establishment)および役努提供の自由(freedom to provids services)の二つの政策を推進してきたが、損害保険に関しては1972年の第3次指令により,遅くとも1994年7月1日までに、各国の国内法を改正するよう指令した。これによって、イギリスでは1994年保険会社法(第3次保険指定)規則を制定し、ほぼ100年近く厳格な法規制をしていたドイツでも新しい保険監督法を制定するなど、各国はその自由化を進めている。研究者は8月および10月、イギリスおよびドイツに出張する機会があった折、両国の保険監督官庁、大学の保険研究所等を訪問して、自由化の進捗状況と問題点を調査した。第3次指令の反映状況は国によって異なっているが、やがて上記の二つの政策は国内法でも裏付けられて、実現の見込みである。このために、たとえば300年の歴史を有するハンブルクの公営火災金庫の独占は廃止され、イタリアの生命保険国営事業であったINAは民営化されつつある。2.保険の自由化と日米包括経済協議について、研究者がこのテーマを設定した時にすぐに開始されていた日米協議は1年余りの間に16回の協議を重ねた後、10月1日アメリカ(USTRが交渉相手)政府と日本政府の間で調印に至った。その結果「規制緩和措置」として商品および料率認可、ブローカー制度の導入、国境を超える取引の自由化などが合意されたが、第3分野自由化の先送り、系列問題の調査などアメリカの要求を飲んだ点がある。保険業法の改正について。この問題は現在法制局で準備中であるが、研究者の研究成果がかなり反映されている。
