Employee with mental illness and the mechanism to ensure their rights

有精神健康问题的员工的疾病有困难，这使得他们难以有效地坚持自己的权利，即使法律保障了他们的一些福利。为了找到解决这一问题的办法，本研究重点研究了美国残疾人权利保障法律--美国残疾人法案(ADA)。本文研究了ADA针对精神障碍员工的纠纷解决机制。研究表明，公共组织提供的调解有效地解决了纠纷，而不是将它们诉诸法院。此外，该研究还提出了一项有效解决日本精神健康问题员工纠纷的计划草案。

Employees with mental health problems have difficulties for their illness that make it challenging for them to insist on their rights effectively even if laws guarantee some benefits for them. In order to find a solution to this problem, this study has focused on the ADA(Americans with Disabilities Act), which is the law guaranteeing rights for the disabled in the US. This paper has examined the ADA's dispute resolution system for employees with psychiatric disorders. The research has shown that mediations provided by public organizations effectively resolved disputes rather than taking them to the court. Moreover the study proposes a draft plan for effectively resolving disputes of employees with mental health problems in Japan as well.
