本研究は、我が国で警察官権限法制の見直しが進んでいない要因について、社会・文化的に日本との共通点が多いにもかかわらず法整備が随時行われている韓国・台湾両法域との違いを分析・比較検証することによって明らかにし、今後の我が国の治安課題や治安行政の在り方に適合した具体的かつ現実的な警察官権限法制の整備に必要な条件を整理し、法制整備のモデルを提示することを目的としている。令和４年度においては、両法域の警察官権限法（韓国：警察官職務執行法、台湾：警察職権行使法）の制定・改正に係る議会関係資料のほか、関連する学術的論考、学術セミナー資料等を幅広く収集し、立法過程での政治的・法制的議論の状況、これらの法整備に対する学術的観点からの事前事後の評価、未整備部分についての議論等に関する整理・分析を行った（整理・分析については、韓国に係る作業を先行した。）。その暫定的な成果としては、警察官権限法制の整備に影響を及ぼし得る日韓間の有意な差異たり得るものとして、南北対立に起因する現実の社会状況のほか、〇警察当局及び司法部における法解釈の態度、〇法律事項のとらえ方を始めとする法制実務・文化の在り方、〇議員立法の位置付け及び手続、〇法案形成過程における民意集約の手法、〇国家人権委員会の存在、〇治安立法争点化に対する意識、〇データ保護に対する意識、〇刑事訴訟法体系の違いに由来する警察観、〇学界及び警察部内の警察行政法研究体制、〇外国法研究の実情及びその国内法への影響力、〇学界と実務界との関係等の要素を抽出しており、これらの法制整備への具体的影響の程度等について引き続き分析中である。
