项目摘要

本年度は、引き続いて、法的推論を可能にしている知識を、面接により識別することを目指し、(1)交通事故損害賠償に関する、逸失利益算定の際に比較的議論の分かれる問題を実験的に与えて得られた問題解決の際の発話思考に準ずる記録を分析することにより、論証の構造と推論が依拠している知識を識別する、(2)できるかぎり識別された知識のみにもとづいて知的な人間の被験者にこうした問題に回答させることにより、予備的な紙上シミュレーションを行う、(3)そうした知識をより明細化するため、実験的変形(「もしXがX1でなくX2だったら、あなたの判断はどうなるか」「判決がY1でなくY2になるには、Xはどうでなければならないか」など)を伴う査問を行い、判断の変更点を識別する、の三つを実施した。面接調査の対象は、司法関係者(弁護士)、法学部教官・教員、法学専攻の大学生である。その結果、(1)に関しては次の諸点が明らかになった。1.ここで用いた問題に関するかぎり、交通事故損害賠償の専門家といえども、必ずしも類似した判断を示すとは限らない。2.しかし、その推論過程には、一般大学生にはほとんど見られなかった特徴が共通に観察される。中でも当然とはいえ目立つのは、判例への言及である。3.もう一つの特徴は、ある種の原則ないし法的推論に対するメタ認知的信念の表明である。4.条文に基づく推論は見られないが、「ある事象の生起が高度に蓋然的であれば、その事象が生じたとして損害賠償額を算定する」という規則などは共有されているとみられる。
