本年度も引き続いて、交通事故損害賠償の算定に関する問題を実験的に与え、得られた問題解決の際の発話思考に準ずる記録を分析することにより、論証の構造と推論が依拠している知識を明細化することを試みた。対象は、司法関係者(弁護士)3名、法学部教官・教員3名、法学専攻の大学生8名、一般大学生8名である。熟達者(弁護士、法学者)の推論に関して、次の諸点が明らかになった。1.ここで用いた問題に関するかぎり、交通事故損害賠償の専門家といえども、必ずしもほぼ等しい判断を示すとは言えない。例えば、被害者が大学を卒業したであろう可能性がどれほどであれば「蓋然性が十分に高い」と判断するかには個人差があり、またこの可能性をどの要因にもとづいて認定するかも異なる場合がある。2.熟達者の推論過程の特徴の一つは、判例への言及である。これには、個別事例への言及ばかりでなく、「従来の判例の傾向から見ていくと、やっぱり、ある程度優秀な者でないと大学には入れないという判例が多いんですよ」のように、一連の事例に基づく一般化された言及もある。3.第二の特徴として、問題をより一般的な問題のクラスの一例として記述し直す、ということが観察された。これは従来の熟達化研究で、領域固有の知識を用いた適切な問題表象の構築と呼ばれていた過程に相当する。4.もう一つの特徴は、ある種の原則ないしメタ認知的信念の表明である。「私自身は、本人の逸失利益を(家族が)相続するという、そういう法制は取らない方がいいというふうに考えてますので・・・」など。
