法的推論におけるさまざまな程度の熟達者が行なう推論過程、とくにそこにおいて法律的および法律外の知識がいかに利用されるかを認知科学的手法を用いて明かにし、より高度のエキスパートシステム構築のための情報を提供することを目指して研究を行った。問題領域として、交通事故損害賠償を選び、しかも比較的議論が分かれそうな問題を3題作成した。これらの問題を実験的に与え、問題解決の際の発話思考に準ずる記録を、司法関係者(弁護士)2名、法学部教官・教員3名、法学専攻の大学生8名を対象として、面接により収集した。これに加え、法学専門科目を履修していない大学生(約100名)にも同様な問題を質問紙により与えて筆答させた。法律(学)関係者の発話記録の分析によると、次の諸点が示唆される。ここで用いた問題に関するかぎり、交通事故損害賠償の専門家といえども、必ずしも類似した解決を示すとは限らない。しかし、その推論過程には、一般大学生にはほとんど見られない、二つの特徴が共通に観察される。一つは、判例への言及である。(「医学部の学生が交通事故にあって死亡した場合、その被害者の所属していた医学部が医者になれる可能性が高い大学である場合には・・・裁判所が医師の収入に基づいて逸失利益を算定したという例がいくつか見受けられる・・・」など。)もう一つは、ある種の原則ないし法的推論に対するメタ認知的信念の表明である。(「損害賠償の問題を考える時には、損害の公平な分担ということをやはり第一に考えなければいけない・・・」など。)前者は典型的な事例に基づく推論であろうが、後者は法という領域に固有とはいえ、一般的原理に基づく推論といえよう。
